Terms and Conditions of Membership

Terms and conditions for members of British Triathlon Home Nations, Triathlon England, Triathlon Scotland and Welsh Triathlon 

1.    Introduction: 
These are the terms and conditions applicable to all members of British Triathlon Home Nations Triathlon England, Triathlon Scotland and Welsh Triathlon.  

Please read these terms and conditions (the “Terms”) carefully to ensure that you understand and agree to them, as they contain the legal terms and conditions that all members shall be deemed to have agreed to when submitting their application for membership. All Members must adhere to these Terms at all times.

Triathlon England and Welsh Triathlon membership is operated by the British Triathlon Federation (“BTF”), a company registered in England and Wales, registration number 02995438, whose registered postal address is Michael Pearson East, British Triathlon Federation, 1 Oakwood Drive, Loughborough, Leicestershire, England, LE11 3QF.

(Triathlon Scotland membership is operated by the Scottish Triathlon Association Ltd, a company registered in Scotland, registration number SC202299, whose postal address is Triathlon Scotland, Gannochy Sports Centre, University of Stirling, Stirling, FK9 4LA.) 

Any references to “we”, “us” or “our” shall be taken as references to BTF. Any references to “you” or “your” shall be taken as references to any applicant for Triathlon England, Triathlon Scotland or Welsh Triathlon membership.

The Terms and Conditions of Use of the British Triathlon Home Nation membership website as found at https://www.britishtriathlon.org/members-area/login  (the “Site”) shall apply to the Site and your use of it.

2.    Membership Period: 
Unless terminated early in accordance with these Terms, Membership is valid from the date that you receive confirmation of your Membership in accordance with paragraph 4 below and shall run for twelve months until the last day of the month in which you purchased or renewed your membership (the “Membership Period”).

 3.    Membership entitles you to the following benefits: 

  • A digital membership card or a membership card/race licence online, dependent on membership options purchased (the “Membership Card/Race Licence”)
  • An email confirmation letter confirming your membership of British Triathlon (the “Confirmation Letter”)
  • Access to the member’s area of the Site during the Membership Period (My Account)
  • The option to purchase additional items via My Account
  • An insurance benefit and/or access to legal services depending on membership options purchased 

4.    Membership Application Process: 
It may take up to 10-14 days from receipt of your completed Membership application for it to be processed. We will email you to confirm receipt of your completed application for Membership. Following our approval of your Membership, your Membership “status” on the Site (“Membership Status”) will show as “valid” and and your Membership pack consisting of your digital Membership Card/Race Licence and your physical or digital Confirmation Letter (your “Membership Pack”) will be posted out or emailed to you. Once processed and posted or emailed, we will assume receipt of your Membership Pack. It is your responsibility to notify us using the contact details at the end of these Terms if you do not receive your Membership Pack.

5.   Non-UK Resident Members: 
Any Member who is a non-UK resident or who at any point during the Membership Period becomes a non-UK resident should be aware of the following: 

(i)    You will be liable to pay any applicable sales tax or other taxes in connection with your Membership and any additional items purchased via the Site
(ii)    If you reside more than 180 days outside the UK you may only be covered under certain elements of the insurance benefit provided to Members. Any Member purchasing the insurance should make him/herself aware of the terms and other details of such insurance in accordance with paragraph 10 below. 

6.   Refunds: 
Should you change your mind about joining after you have submitted your application for Membership, a full refund will only be available if you notify us of your wish to cancel your Membership in writing to the email address or postal address at the end of these Terms and return any and all membership materials (including your Membership Pack and Member Gift) by post, at your own cost, to British Triathlon’s postal address, within fourteen days of your Membership Status on the Site being changed to “valid” by British Triathlon. No refunds will be issued after this time.  Please note that if you begin to utilise your Membership, for example by entering races using your membership number or accessing any materials within your membership area (My Account), your right to cancel your Membership and receive a refund of your Membership fee shall immediately cease.
        
No refunds or extensions will be given if you are unable to use any part of your Membership at any stage during the Membership Period including any result of any suspension or early termination of your Membership pursuant to these Terms. Downgrades are also not permitted during the Membership Period.

Deceased members:  A  full refund will only be given to deceased members if we are notified of the need to to cancel Membership in writing to the email address or postal address at the end of these Terms and there is a return of any and all membership materials (including the Membership Pack and Member Gift) by post, at no cost to British Triathlon, to British Triathlon’s postal address, within fourteen days of the Membership Status on the Site being changed to “valid” by British Triathlon. If we are notified of the need to cancel Membership outside of the fourteen days of the Membership Status on the Site being changed to “valid” by British Triathlon refunds will be given on a discretionary basis to deceased members - if more than 3 months of Membership remain then a refund will be given on a pro-rata basis minus a £5 admin fee from the date we are notified of the cancellation. If less than 3 months of Membership remain, no refund will be given. Refunds for deceased members can only be made to the estate of the decased member. 

7.   Membership Card/Race Licence and other details: 
Your Membership Card/Race Licence will remain the property of British Triathlon at all times.

Membership Cards/Race Licences and all benefits of Membership are non-transferable and can only be used by the named Member.

Lost or stolen Membership Cards/Race Licences should be notified to us as soon as you become aware of it. 

You must ensure that you keep your Membership details, including your username and password for the Site, secure and you should not disclose them to anyone, as you will be responsible for all activities which occur under your username and password. It is your responsibility to notify us immediately of any unauthorised use of your username or password or any other breach of security as soon as you become aware of it.

8.   Membership renewals: 
We will endeavour to contact you at least 10 days before your Membership is due for renewal, detailing the expiry date of your current Membership and any further actions you may need to take in order to renew your Membership. It is your responsibility to keep your email address updated within your My Account area.

9.  Membership number 
Your Membership number is unique to you and cannot be transferred to any other person at any time for any use.

10. Insurance: 
As part of your application for Membership, you may (dependent on the package purchased) receive public liability and/or personal accident insurance made available by British Triathlon to Members.

The insurance made available by British Triathlon to Day Members (the “Insurance”) is provided by Bluefin Sport. Bluefin Sport is a trading name of Marsh Ltd. Marsh Ltd is authorised and regulated by the Financial Conduct Authority. 

The full details and terms of the policy for such Insurance can be accessed via the British Triathlon website. We reserve the right to amend the policies at any time. 

Any Member purchasing the Insurance should make him/herself aware of the terms and other details of such Insurance.

11. Termination: 

We reserve the right, in our sole discretion, to

(i) Refuse Membership; and/or 
(ii) Suspend Membership; and/or 
(iii) Terminate Membership; 

in the following circumstances if

a)    You breach these Terms or any other requirements set out on the Site in any manner and at any time;
b)    You fail to meet, or at any point during the Membership Period cease to meet, the required criteria for Membership (as set out on the Site);
c)    You are suspended or barred (on an interim or permanent basis) from any triathlon activity pursuant to the rules and regulations of British Triathlon, including, but not limited to, British Triathlon Code of Ethics, British Triathlon Safeguarding Children Policy, British Triathlon Safeguarding Adults at Risk Policy, British Triathlon Equality & Diversity Policy, Transgender Policy and British Triathlon Anti-Doping Rules;
d)    In the reasonable opinion of British Triathlon, you act in any manner which brings British Triathlon or triathlon activity into disrepute including but not limited to non-compliance with the British Triathlon Code of Ethics, British Triathlon Safeguarding Children Policy, British Triathlon Safeguarding Adults at Risk Policy, British Triathlon Equality & Diversity Policy, Transgender Policy and British Triathlon Anti-Doping Rules that adheres to guidelines recommended by the World Anti-Doping Agency (WADA), non-compliance with the British Triathlon Competition rules or non-compliance with the International Triathlon Union (ITU) Anti-Doping rules; or
e)    In the reasonable opinion of British Triathlon, you misuse your Membership in any manner.

In all such cases we will have no liability to refund you or pay any other compensation to you in connection therewith. In the event of a suspension, British Triathlon may decide in its discretion to lift such suspension when it considers it is appropriate to do so.

In the event that we terminate or suspend your Membership:

(a)  Your access to My Account will be suspended or terminated as appropriate. British Triathlon may, in its sole discretion, permit you access to certain parts of My Account after such termination or suspension for a period as it considers fit. In the event that any Membership suspension is lifted, full access will resume;
(b)  You should immediately cease use of your Membership Card/Race Licence. If your Membership is terminated or is suspended for a period of longer than 7 days (or such shorter period as notified by British Triathlon from time to time), you must promptly return your Membership Card/Race Licence to us at the postal address at the end of these Terms. If British Triathlon does not receive your Membership Card/Race Licence within 28 days of the date your Membership is terminated or suspended (or such shorter time as British Triathlon considers appropriate in the circumstances), we reserve the right to contact any triathlon club, to whom you are connected and/or the Regional Committee(s) and/or race organisers to inform them that your Membership has been terminated or suspended;

(c)  You should immediately cease to hold yourself out as being a Member and to exploit any of the benefits of Membership.

12. Privacy: 
Your personal information will be used in accordance with our privacy policy and the contact/privacy options you select when submitting your application for Membership.

13.  Amendments: 
We reserve the right to amend these Terms with or without notice to you from time to time. Any such amendment shall be effective once the revised Terms have been posted on the Site, and it shall be your responsibility to check these Terms for any such amendments. To the extent that any amendment to the Terms affects your rights or responsibilities in connection with your Membership, we shall notify such changes to you in advance of them becoming effective.

British Triathlon reserves the right to re-brand or re-name Membership products at any time.

British Triathlon reserves the right to offer promotions or discounts on Membership products that may apply to all or any number of individual Home Nation Memberships. 

British Triathlon withholds the right to amend or remove membership benefits that apply to all, or any number of individual Home Nation Memberships, at any time.

14. Ownership of Materials and Intellectual Property Rights: 
British Triathlon or its affiliates or licensors are, unless otherwise stated, the owners of all copyright, database and other intellectual property rights in all materials provided or made available to you as part of your Membership either on the Site or in hard copy (the “Membership Materials”), with all rights reserved. This includes, without limitation, copyright and other intellectual property rights in videos, presentations, photographs, audios, documents and other text in such Membership Materials. You may not copy, publish, distribute, extract, re-utilise, or reproduce any part of the Membership Materials in any form (including photocopying or storing it in any medium by electronic means) other than (i) as specifically required to be permitted by applicable law, or (ii) as specifically provided by British Triathlon on a case by case basis. In particular, you shall not incorporate any Membership Materials in any commercial work or publication, whether in hard copy or electronic or any other form, and no part of any Membership Materials may be distributed or copied for any commercial purpose.

All brand, product and service names, logos and images used in the Membership Materials are the property of British Triathlon or its affiliates or licensors, unless otherwise stated, with all rights reserved. You may not distribute products or offer services under or by reference to or otherwise use or reproduce any of the trademarks, trade names or service marks on the Membership Materials without the prior written permission of British Triathlon or, where applicable, the owner of such trademarks, trade names or service marks.

15. Disclaimer of Warranties and Liability: 
To the fullest extent permitted by English law, British Triathlon makes no representations, undertakings or warranties about the Membership, or any content or information provided as a result of being a Member. To the fullest extent permitted by English law all representations, warranties and undertakings (express or implied) in respect of Membership are excluded.

16.  Liability: 
Except in the case of fraud, death or personal injury caused by our negligence or other cases where by law liability cannot be excluded or limited, we exclude all liability to you in respect of your application for Membership, or any information or other content obtained either directly or indirectly as a result of your Membership, howsoever arising, in any circumstances and whether in contract, tort, negligence, misrepresentation or otherwise.

Under no circumstances shall we have any liability for any loss of profit, business opportunity, goodwill, anticipated savings or data, or for any special, indirect, incidental or consequential loss or damages of whatsoever kind resulting from your application for Membership, or any information or other content obtained either directly or indirectly as a result of your Membership, howsoever arising, in any circumstances and whether in contract, tort, negligence, misrepresentation or otherwise.

17. Clean Sport

A member of a British Triathlon Home Nation of Triathlon England, Triathlon Scotland or Welsh Triathlon shall be deemed to have made themselves familiar with and agree to be bound by the Anti-Doping Rules of British Triathlon and to submit to the authority of UK Anti-Doping in the application and enforcement of the Anti-Doping Rules. 

The Anti-Doping Rules of British Triathlon cited in the British Triathlon Competition Rules, apply to all persons with a membership who participate in competitive activity for whichever is the longer; a) the length of the membership period; or b) 12 months from the date of the competitive activity the participant took part in, whether or not the participant is a citizen of, or resident in, the UK.

You agree for British Triathlon to share your information, where relevant, with UK Anti-Doping (or its successor) for the purpose of intelligence sharing in relation to possible anti-doping rule violations. This information will be shared in a secure manner.

18. Safeguarding and Sport Integrity

Safeguarding is a fundamental part of British Triathlon and the Home Nations role and our ongoing duty to ensure that all children adults who participate in triathlon have a safe, enjoyable and positive experience. British Triathlon and Home Nations are also committed to upholding and protecting the organisation’s vision and values, and maintaining the highest possible standards of sporting integrity. As a member of a British Triathlon Home Nation of Triathlon England, Triathlon Scotland or Welsh Triathlon you agree to be bound by abide by British Triathlon’s policies, rules and regulations including but not limited to the British Triathlon Code of Ethics, Safeguarding Children Policy, Safeguarding Adults at Risk Policy, Equality & Diversity Policy, and Transgender Policy.

19. General: 
These Terms and all aspects of Membership are governed by and will be construed in accordance with the laws of British Triathlon and Home Nations England, Scotland and Wales. Any disputes arising under or in connection with these terms and conditions shall be subject to the non-exclusive jurisdiction of the English courts.

Any failure by us to exercise any right or remedy under these Terms or at law does not constitute a waiver of that right or remedy or a waiver of any other rights or remedies. No single or partial exercise of a right or remedy by us under these Terms or at law prevents further exercise of the right or remedy or the exercise of any other right or remedy.

If a competent court of law or authority finds that any part of these Terms is invalid, unlawful or unenforceable to any extent, we shall delete the relevant part from the Terms and the remainder of the Terms shall continue to be valid and enforceable to the fullest extent permitted by the laws of England, Scotland and Wales.
